SOCIALFORGE TERMS OF SERVICE Version: 1.2.2 Effective Date: 2026-02-15 Last Updated: 2026-02-15 Operator and Legal Entity ------------------------- The Social Forge (“we”, “our”, “us”) is a digital platform owned and operated by M & W Logistics LLC d/b/a The Social Forge, a Virginia limited liability company (“Company”). These Terms of Service (“Terms”) govern your access to and use of The Social Forge’s products and services (“Service”). 1. ACCEPTANCE OF TERMS ---------------------- By accessing or using the Service, you agree to be bound by these Terms and all incorporated policies, including our Privacy Policy and Acceptable Use Policy. If you are entering into these Terms on behalf of an entity, you represent that you have authority to bind that entity. 2. ELIGIBILITY -------------- You must be at least eighteen (18) years old to use the Service. By using the Service, you represent and warrant that: - You are at least eighteen (18) years old. - If you upload content containing nudity, sexual activity, or sexually explicit material, all individuals depicted in such material are at least eighteen (18) years old. This restriction does not prohibit non-sexual content that incidentally includes minors in lawful public or commercial settings. We reserve the right to request additional verification or suspend accounts if we believe this section has been violated. 3. DESCRIPTION OF SERVICE ------------------------- The Social Forge provides a cloud-based social media management platform enabling users to: - Upload and manage media. - Schedule and publish content. - Generate AI-powered captions. - Access analytics. - Manage connected social accounts. Features dependent on third-party APIs may change without notice. 4. USER CONTENT --------------- You retain ownership of content you upload. You grant us a limited license to store, process, and publish content solely to provide the Service. You are solely responsible for: - The legality of your content. - Compliance with applicable laws. - Compliance with third-party platform policies. Platform approval does not constitute legal compliance. 5. PROHIBITED CONTENT --------------------- You may not upload or publish content that: - Violates intellectual property rights. - Contains harassment, hate speech, or unlawful discrimination. - Contains malware or harmful code. - Violates applicable laws or regulations. - Depicts or exploits minors in any sexual context. - Contains child sexual abuse material (CSAM). - Depicts non-consensual sexual activity. - Contains synthetic or AI-generated sexual depictions of minors. 6. CONTENT MODERATION --------------------- We do not proactively review all user content. However, we may use automated systems and, when appropriate, manual review processes to detect policy violations, illegal material, or security risks. Automated detection systems are not guaranteed to identify all violations or illegal content. We reserve the right to remove, restrict, disable access to, or quarantine content that violates these Terms or applicable law. 7. ENFORCEMENT AND REPORTING ---------------------------- If we become aware of content that appears to violate applicable law or these Terms, including content involving minors, we may: - Remove, disable, or quarantine such content. - Restrict, suspend, or terminate the associated account. - Preserve relevant logs, records, and evidence. - Report the matter to appropriate authorities where required by law or where we reasonably believe such reporting is appropriate. Nothing in these Terms obligates us to proactively monitor all user content. 8. THIRD-PARTY INTEGRATIONS --------------------------- Your use of connected social media platforms remains subject to their terms and policies. We are not responsible for third-party platform actions, outages, or API changes. 9. SUBSCRIPTIONS AND BILLING ---------------------------- Subscriptions are billed in advance. No refunds are provided after a billing cycle begins unless required by law. 10. LIMITATION OF LIABILITY --------------------------- THE SERVICE IS PROVIDED “AS IS.” OUR LIABILITY SHALL NOT EXCEED THE LESSER OF: - FEES PAID IN THE LAST 12 MONTHS, OR - $100 USD. 11. INDEMNIFICATION ------------------- You agree to indemnify and hold harmless The Social Forge from claims arising from: - Your use of the Service. - Your uploaded content. - Your violation of these Terms. 12. TERMINATION --------------- We may suspend or terminate accounts for: - Violations of these Terms. - Illegal activity. - Fraud or abuse. - Non-payment. 13. GOVERNING LAW ----------------- These Terms are governed by the laws of the Commonwealth of Virginia. 14. MODIFICATIONS ----------------- We may update these Terms.
